The rules of the road for using Sawary.

Read this carefully. By creating a Sawary account or using the Sawary mobile app, you agree to these terms. If you do not agree, do not use the service.

1. Who we are and what Sawary is

Sawary is operated by Sawary, registered in Pakistan (TBD), with its registered office at haseebleoo@gmail.com.

Sawary is a carpool platform. We connect individual commuters who want to share the cost of a journey they were both making anyway. Sawary is not a transport operator, does not employ drivers, does not own vehicles, and does not provide taxi, ride-hail, or public transport services.

6. Booking, cancellation, and refunds

6.1 Free cancellation

You may cancel a confirmed booking for free up to 30 minutes before departure minutes before the scheduled departure time.

6.2 Late cancellation

If you cancel within 30 minutes before departure minutes of departure, or if you do not show up for a confirmed booking, a penalty of PKR 50 or 10% of fare, whichever is lower may apply. The penalty exists to compensate the driver, who has already committed their time, fuel, and route.

6.3 Driver cancellation

If a driver cancels a confirmed ride, you receive a full refund of any fare already paid, and the driver is subject to our cancellation policy.

6.4 Refunds

Refunds for trips cancelled by the driver, or for verified service issues, are processed within 7 business days. We do not charge a fee for issuing a refund.

7. Pricing and payment

Fares are quoted in Pakistani Rupees (PKR). The fare is split between the driver and the passengers as displayed in the app at the time of booking.

Sawary's current platform fee is 0% during v0.1.0 launch (no platform fee for riders or drivers). We will give you at least 30 days' notice in-app before changing the platform fee.

8. Ratings and reviews

After every ride, both the rider and the driver are asked to rate each other on a 5-star scale and to leave a short written review. Ratings are public. Reviews are public but the author can be reported for abuse.

We do not delete ratings or reviews except where they violate our Community Guidelines or are the subject of a valid legal complaint.

9. Community standards and conduct

All Sawary users must follow our Community Guidelines. In summary: treat each other with respect, no harassment or discrimination, no smoking or alcohol in vehicles, respect the female-only ride filter, and report problems through the app rather than taking them into your own hands.

10. Suspension and termination

We may suspend or permanently terminate your account if you:

Where appropriate, we will give you a warning and a chance to respond before a permanent ban. For serious safety violations (assault, threats, fraud), we may suspend immediately.

11. Safety and SOS

Sawary includes a one-tap SOS feature. Activating SOS shares your live ride location and ride details with your nominated emergency contacts, and notifies our safety team. SOS is not a substitute for dialling Pakistan's emergency number (15 for police, 1122 for ambulance). In an immediate emergency, contact emergency services first.

12. Disclaimers

Sawary is a carpool platform. We are not a transport operator. We do not warrant the conduct, safety, or reliability of any individual user. You use the service at your own risk, and you are responsible for exercising your own judgment about whether to ride with or drive for a particular person.

The service is provided "as is" and "as available." To the maximum extent permitted by Pakistani law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

13. Limitation of liability

To the maximum extent permitted by Pakistani law, Sawary's total liability to you for any claim arising out of or relating to the service is limited to the total platform fees you have paid to Sawary in the 12 months immediately before the event giving rise to the claim.

Sawary is not liable for indirect, incidental, special, or consequential damages, including lost profits, lost data, or emotional distress.

14. Indemnity

You agree to indemnify Sawary and its officers, employees, and agents against any third-party claim arising out of your breach of these Terms, your misuse of the service, or your violation of any law.

15. Governing law and disputes

These Terms are governed by the laws of the Islamic Republic of Pakistan. Any dispute arising out of or in connection with these Terms that cannot be resolved through our support process within 30 days will be subject to the exclusive jurisdiction of the courts of Karachi.

16. Changes to these Terms

We may update these Terms as the product or the law changes. Material changes will be announced in the app and by email at least 14 days before they take effect. Continued use of the service after the effective date constitutes acceptance of the new Terms.
